How Are Theft Crimes Classified in Indiana?
In Indiana, theft crimes are classified based n the type of property stolen, its value, the circumstances involved, and a prior criminal history. State law also establishes advisory sentences for each level of a felony offense.
Level 5 felony theft is the highest theft level and it includes:
- Property that is valued at $50,000 or above
- A second offense for the theft of an automobile or its parts
- Theft of valuable metals, which could create a significant risk of bodily injury to others, is stolen from a health care facility, or relates to public safety
The penalty for a class 5 felony is 1 to 6 years imprisonment and a fine of up to $10,000.
A theft that is not considered a felony will be treated as a class A misdemeanor, including a first-time offense where the stolen property is not a motor vehicle, a firearm, or the value was under $750. If you are convicted of a class A misdemeanor, you can potentially face up to one year in jail and a fine of up to $5,000.
In 2014, the majority of theft-related offenses and penalties were consolidated into one penalty section and one definition section.
